For fourteen years now, we have been committed to protecting the rights of investors
Since 1994, the attorneys of Germany's first law firm organized as a stock corporation, Nieding + Barth, have been committed to protecting the rights of private stockholders and institutional investors. Regardless of what the general economic framework conditions may be, our law firm is involved in many aspects of the capital market: each year, investors suffer great losses because investment advisors, asset managers and financial services providers have not exercised due care in working with the funds with which they have been entrusted, or because someone has even swindled them out of their money. Increasingly, we assist creditors in enforcing their rights against companies that have fallen into insolvency. Our impressive track record bears witness to our many years of commitment. Thus, we have represented investors from Germany and abroad in litigation and out of court for a total damage amount of more than EUR 6.5 billion. The supreme courts of Germany have listened to what we have to say: 25 rulings have been handed down by the Federal Court of Justice on matters that we have brought before the German courts. Moreover, by submitting statements on the respective bills, our attorneys have contributed to the major law-making processes of the past ten years serving to regulate the capital market.
We advocate investors' rights - at the national and international level
Nieding + Barth Rechtsanwalts AG is committed to protecting the rights of investors by obtaining judgments awarding damages to our clients, both within Germany and abroad. In the United States, we work together with our partner law firms Coughlin Stoia Geller Rudman Robbins LLP and Spector Roseman & Kodroff . In Europe and beyond, we are part of the international AEA network of attorneys, of which more than 600 law firms are a member.
Experts on the capital market in committees and associations
Due to our in-depth experience and knowledge of the law, the investment law specialists of Nieding + Barth are regularly involved by German law-making committees. Moreover, we are represented in renowned organizations protecting the justified interests of private investors. This includes, to cite but a few examples, Deutsche Schutzvereinigung für Wertpapierbesitz e.V., Germany's leading association of stockholders, the Deutscher Anlegerschutzbund e.V. protecting investors, and Arbeitskreis Anlegerschutz der Bundesanstalt für Finanzdienstleistungsaufsicht BaFin , a stockholder protection working group closely associated with the Federal Supervisory Office for Financial Services.
Representation of investors in insolvency proceedings
Our law firm has gained a reputation throughout Germany for its competence in insolvency law. Klaus Nieding has been appointed as Joint Agent of the owners of bearer debentures and of convertible bonds in insolvent companies, last by the Amtsgericht (local court) of Frankfurt am Main (for the insolvency proceedings of Gontard & Metallbank AG) and by the Amtsgericht (local court) of Wuppertal (for the insolvency proceedings of Gold-Zack AG). Mr. Nieding represents creditors' claims totaling EUR 15 million or, respectively, EUR 56 million, both in the insolvency proceedings as such and in the respective creditors' committees of the companies. These latter committees are central to such proceedings, since they closely cooperate with the insolvency administrator and decide, among other things, on how to distribute the funds still remaining. |
